HIPAA Notice of Privacy Practices

This Notice describes how medical information about you may be used and disclosed and how you can get access to this information.
Please review it carefully.
Saber Tactical Performance & Rehab (“we,” “our,” “the clinic”) is committed to protecting your protected health information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA).
This Notice applies only to physical therapy (medical) services.
Performance Coaching and other non‑medical services are not subject to HIPAA and are stored separately.
1. Our Responsibilities
We are required by law to:
Maintain the privacy of your PHI
Provide you with this Notice of our legal duties
Notify you if a breach of unsecured PHI occurs
Follow the terms of this Notice
We may update this Notice at any time. The updated version will be posted on our website.
2. How We May Use and Disclose Your PHI
We may use or disclose your PHI for the following purposes without additional authorization:
A. Treatment
To provide, coordinate, or manage your medical care.
Examples include:
Evaluations and treatment sessions
Communication with referring providers
Coordination with specialists
VA Community Care documentation
Only the minimum necessary PHI required by the VA is included in HSRM submissions.
We use AI‑assisted documentation tools to support medical note generation. These tools process only clinician‑entered information and do not access or use client media without consent.
B. Payment
To obtain payment for services.
Examples include:
Submitting documentation through HSRM for VA referrals
Providing superbills for out‑of‑network reimbursement
We do not bill private insurance directly.
C. Healthcare Operations
For administrative, quality improvement, and compliance purposes.
Examples include:
Internal record keeping
Training and supervision
Clinic operations and audits
Physical therapy documentation does not determine duty status, return‑to‑duty clearance, or occupational qualification.
3. Other Uses and Disclosures Allowed by Law
We may also disclose PHI without your authorization when required by:
Law enforcement
Public health authorities
Workers’ compensation programs
Court orders or subpoenas
Health oversight agencies
Serious threats to health or safety
We will disclose only the minimum necessary information.
4. Uses and Disclosures Requiring Your Authorization
We will not use or disclose your PHI for the following without your written permission:
Marketing
Sale of PHI
Release of psychotherapy notes
Non‑treatment‑related communication
Media, photos, or testimonials
You may revoke authorization at any time in writing.
5. Your Rights Regarding Your PHI
A. Right to Access
You may request to view or obtain a copy of your medical records.
B. Right to Amend
You may request corrections to your PHI if you believe it is inaccurate or incomplete.
C. Right to Request Restrictions
You may request limits on how your PHI is used or disclosed.
We are not required to agree to all requests.
You may request that AI‑assisted tools not be used in your documentation. We will honor this request whenever feasible.
D. Right to Confidential Communications
You may request that we contact you in a specific way (e.g., phone, email).
E. Right to an Accounting of Disclosures
You may request a list of certain disclosures we have made.
F. Right to a Paper Copy of This Notice
You may request a printed copy at any time.
You may request a printed copy during any in‑person visit or by contacting us directly.
6. VA Community Care and HIPAA
For veterans receiving care through the VA Community Care Network (CCN):
PHI may be shared with the VA through HSRM
Documentation follows VA standards
Only PT services are covered under VA authorization
Non‑medical services (Performance Coaching, Hybrid Sessions) are not part of VA coverage and are not included in VA documentation
7. Non‑Medical Services Are Not Covered by HIPAA
Performance Coaching and other non‑medical services are not subject to HIPAA.
These services maintain separate records that do not contain PHI.
Readiness scores and performance metrics are non‑medical and are not part of your medical record.
8. Complaints
If you believe your privacy rights have been violated, you may file a complaint with:

You will not be penalized for filing a complaint.
